Monsanto must pay couple $2bn in largest verdict yet over cancer claims

A jury ordered agribusiness giant Monsanto Co, which is owned by German chemical firm Bayer, to pay the sum to the couple, who claimed the company's popular weed killer Roundup Ready caused their cancers.

Bayer's value has fallen roughly 45 percent since its $63 billion acquisition of Monsanto, the maker of Roundup, was completed a year ago.

It called the jury's decision "excessive and unjustifiable" adding that both Alva and Alberta Pilliod had histories of illnesses that were known risk factors for non-Hodgkin's lymphoma. The Pilliods both have non-Hodgkin's lymphoma.

Monday's decision follows an $80 million judgment in March to a California man who said Roundup gave him non-Hodgkin's lymphoma.

Bayer's legal troubles are far from over: The company potentially faces thousands of lawsuits from people whose farming and landscaping work brought them in direct, sustained contact with Monsanto's herbicides.

Glyphosate was developed by Monsanto in the United States in the 1970s and has become one of the most widely used ingredients in weed killers worldwide. The damages award is likely to be reduced due to US Supreme Court rulings that limit the ratio of punitive to compensatory damages to 9:1. At its recent annual meeting, a shareholder revolt ensued, with more than half of the shareholders voting against absolving management for its decision to acquire the St. Louis-based seed and pesticide company.

Bayer said the jury was presented with "cherry-picked findings" inconsistent with a statement last month by the US Environmental Protection Agency, which announced that glyphosate was not a carcinogen and posed no public health risk when used as directed.

Bayer in a statement on Monday said it was disappointed with the verdict and will appeal.

"The verdict in this trial has no impact on future cases and trials, as each one has its own factual and legal circumstances", Bayer said.

That figure, which consists of $3 billion in punitive damages and $79 million in compensatory ones, is all but certain to be reduced by the trial judge or on appeal-University of California, Hastings School of Law professor David Levine told the Associated Press there is "There is zero chance it will stand".

A 2017 Reuters investigation found that the World Health Organization's International Agency for Research on Cancer had dismissed and edited out "non-carcinogenic" findings that were at odds with its final conclusion that the chemical probably causes cancer. Earlier this month, the EPA said that glyphosate is not carcinogenic. The court didn't propose a ratio it felt correct, but said punitive damages should nearly never exceed nine times actual damages, it said.

However, Monsanto has also faced accusations that it benefited from a cosy relationship with EPA officials and that it interfered with supposedly independent scientific reviews that concluded Roundup is safe.

Bayer has seen its stock price plummet 40 percent since it purchased Monsanto past year for $63 billion.

Bayer's share price has lost half its value since it reached s 52-week high of $32.80 a share.
