Google Blocks Chinese App TikTok in India After Court Order

Senior advocate Abhishek Manu Singhvi, appearing for Chinese company ByteDance, said there were over billion downloads of the mobile app and ex-parte orders were passed by the Madurai bench of Madras High Court. ByteDance contended in front of the Supreme Court that the app is like any other social media platform, and singling out of TikTok is discriminatory and arbitrary and that the "disproportionate" ban has resulted in infringement of fundamental right to freedom of speech and expression. The top court referred the case back to the Madras High Court, which on Tuesday refused to lift the ban on the mobile app.

YourStory reached out to TikTok about MeitY's directive to Google and Apple, and the company refused to comment on the matter. And, the three-person Supreme Court bench headed by Chief Justice Ranjan Gogoi will hear the case on April 22 after observing the proceedings tomorrow.

Following up on an interim order from the Madras High Court, The Ministry of Electronics and Information Technology has ordered both Apple and Google to remove the app from their respective stores.

The Madras High Court order asked the federal government to ban TikTok on the grounds that it encouraged pornography and made young users vulnerable to sexual predators. On Tuesday, the court asked Apple and Google to block the TikTok app from its play store. As of writing this report, we can confirm that the video making app is no longer available on the Play Store and App Store in India.

The company released a statement saying that they are optimistic about the outcome.

Google, in an email response to Business Standard, said it does not comment on individual apps but adheres to local laws.

In response to the concerns raised in India, TikTok has removed more than six million videos that violated its terms of use and community guidelines.

The application owned by Chinese firm ByteDance lets users create short videos with a song or a dialogue playing in the background. More than 30 million users installed the app in January 2019, 12 times more than in the same month a year ago.

In its Supreme Court filing, Bytedance argued that a "very minuscule" proportion of TikTok content was considered inappropriate or obscene.
