Smollett's lawyers want focus put on brothers' role in 'attack'

"The two men who attacked him have indicated that they attacked him, so we already know who attacked him", attorney Patricia Brown Holmes said after all 16 charges against Smollett were dropped.

The records conformed with the information included in court filings, including summaries of interviews with the Osundairo brothers who said Smollett gave them a $3,500 check and $100 in cash to buy the rope, ski masks, gloves and red baseball caps used in the attack. The attackers, a pair of Nigerian brothers, the Osundairo brothers, even reportedly knew Smollett - one worked as an extra on "Empire".

In an early morning tweet announcing the review, Trump said the case had embarrassed the nation. Investigators alleged Smollett staged the attack with the hopes of gaining attention and advancing his career.

The decision to drop the charges does not mean the actor was innocent or any new evidence was presented, Magats told CNN affiliate WLS.

In a letter signed by Mayor Rahm Emanuel's senior legal adviser Edward Siskel and addressed directly to Smollett, the city claims Smollett's "false statements" led to police "diverting resources from other investigations and undermining the criminal justice system". The prosecutor wrote to Police Superintendent Eddie Johnson after the contacts to convey that the family wanted the FBI to take over the investigation, according to copies of emails and text released by the State's Attorney's Office.

Glandian then pulled a switcheroo: "The only person who should be apologizing is the mayor and the city of Chicago. So, it's not - it's not implausible", she said.

All charges against the actor were dismissed on Tuesday in exchange for community service and Smollett forfeiting a $10,000 bond payment to the city of Chicago. State's attorney spokeswoman Keira Ellis said Foxx "informally separated herself from the decision-making over the case...in an abundance of caution". Foxx had previously recused herself from the case after reports emerged that she had tried to have the initial fake "hate crime" case transferred to the Federal Bureau of Investigation.

The city of Chicago sent a letter to Jussie Smollett on Thursday demanding the actor pay $130,000 to the city to offset the costs associated with investigating the alleged hate crime hoax he is accused of concocting.

Meanwhile, Smollett's lawyer, Tina Glandian, said she is "not at all" concerned about an investigation of Smollett by the Department of Justice and FBI in an appearance on NBC's Today show Thursday.

Smollett maintained his innocence after charges against him were dropped.
