Ghosn suffers high fever, interrogation suspended

Tokyo prosecutors charged former Nissan Motor Co.

Friday marked the last day of Ghosn's most recent detention period approved by the Tokyo District Court, and prosecutors had to decide whether to indict or release him.

If the bail application is rejected, Ghosn will spend at least another two months in jail, a detention period that can then be extended by the court for a month at a time.

The other new charge says Ghosn reported 2.9 billion yen ($26.9 million) in compensation, when he earned more than 7.1 billion yen ($65.7 million) in the three years ending in June 2018.

Ghosn's defence team had made the bid for his release on the basis that one of the charges against him, an alleged breach of trust of the company, was null and void. The massive losses were generated from a contract over derivative transactions that his asset management company had concluded with a bank.

Ghosn was initially arrested on November 19 last year for allegedly understating about 5 billion yen (45 million dollars) of his 10-billion-yen compensation during the five years through March 2015.

Both Ghosn and Nissan have been accused of violating Japan's Financial Instruments and Exchange Act for the misstatements submitted during the three years in question.

His chief lawyer has said that Ghosn could theoretically be detained for a minimum of another six months, citing the complexities of the case and said that bail is unlikely to be granted as he has unequivocally denied all allegations against him. Nissan has dismissed Kelly from his role as a representative director.

A prosecutor's office spokesperson told AFP that the charges against Ghosn carried a maximum prison sentence of 15 years.

But Ghosn's close aide Kelly, 62, who was arrested along with the former chairman for allegedly understating remuneration, has been released on bail, while denying the allegations.

Ghosn's lawyers requested bail at the Tokyo District Court following the indictments.

"We believe that there was enough to charge and go to trial", he said of Ghosn's case, "and he will be guilty".

Renault said in a statement Thursday that an internal investigation found all payments to its board members in 2017 and 2018 were in compliance with the law and "free from any fraud".

Nissan said an internal investigation began in the middle of past year after whistleblowers came forward.

Renault, which is the biggest shareholder in Nissan, has refrained from removing Ghosn, instead appointing interim replacements.

As part of the scheme, he is also accused of using company funds to repay a Saudi acquaintance who put up collateral for the contracts.
