While some buyers are upset about curved iPad pros, courts in China and Germany are punishing Apple in the lawsuit against Qualcomm. In Germany, Apple can still sell the iPhone 8 and 7 through third party retailers and phone carriers; it just can't sell the models directly. Luckily for Apple, its higher-margin iPhone XS, iPhone XS Max and iPhone XR are not affected by the injunction. According to a German court iPhone 7 and 8 models with Intel modems infringe on one Qualcomm patent. Additionally, the newer iPhone XS, iPhone XS Max and iPhone XR models will still be sold in Germany.

The two U.S. companies are locked in a worldwide dispute over licensing fees Qualcomm charges for use of technology the chipmaker says underpins all modern phone systems. Still, it is a small but clear win in a complex legal battle that will spin into overdrive in the coming months as antitrust regulators and Apple both take Qualcomm to court in the United States.

This is just the latest move in a larger legal battle between the two companies, with Qualcomm's USA complaint set to go to trial next month. However, the American tech giant clarified that this ban on the retail of the iPhones is immediately enforceable and Qualcomm misunderstood the district court's order.

Apple had tried to preempt a ban based on a different feature by altering its software in Germany, the Financial Times reported Wednesday.

This latest development may put a spotlight on how Qualcomm's victories in other territories may have been built on fragile legal maneuverings that would not fly in USA courts. The update was also released as part of an effort to address the Qualcomm patent violation claims in China that led to an injunction for its devices on the local market.

Qualcomm's infringed patent provides a way to mitigate power amplifier power consumption, which enables devices to use power more efficiently and extend battery life in smartphones.

Meanwhile, Jun Zhang believes that current model sales will be taking a cut and that will lead to Apple cutting orders to its supppliers.
