Health Stocks Prepare for Market Jolt After Obamacare Ruling

And on Friday, the judge handed Republicans another victory by striking down the Affordable Care Act, the signature health law of the Obama era. There's nearly no chance this ruling holds.

What is Plan B if the entire law is struck down?

"I believe that's the likeliest outcome, because ObamaCare has always been unconstitutional", he asserted.

O'Connor's decision will nearly certainly be appealed up to the Fifth Circuit Court of Appeals, which could ultimately send the case to the Supreme Court.

What are members of Congress saying?

The Democrats, who gained 40 House seats in the midterm elections, campaigned broadly on the healthcare issue, tapping into the widespread anger in the United States population against soaring healthcare costs and deteriorating medical care.

Some conservative critics have accused him of providing the roadmap to save ObamaCare, citing a 2011 case where Kavanaugh dissented against the ruling but acknowledged the Affordable Care Act's "individual mandate provision" could fit "comfortably within Congress' Taxing Clause power". Supreme Court upholding that statute in 2012. It's never been a proper role for the federal government to regulate health care and health insurance. Judge O'Connor reasoned that the mandate was the linchpin for the rest of the law, and without it the ACA's other provisions would not have been enacted.

Where Roberts might fall this time is anybody's guess - as the case before the lower courts strikes at the heart of his rationale for upholding the law's individual mandate.

U.S. District Judge Reed O'Connor in Fort Worth agreed with a coalition of 20 states that a change in tax law previous year eliminating a penalty for not having health insurance invalidated the entire Obamacare law. The rest of the law can not be separated from that provision and is therefore invalid, he wrote. The Republicans campaigned heavily on "repealing and replacing" the ACA ("Obamacare") in 2016, pointing to massive increases in premiums for health insurance plans as evidence that the law was failing.

But Owen is a fan, saying on BT Sport: "I think the manager has to take some of the blame - the system, the way he plays". Most of the time it's the goals that command the headlines, but this week it seems saves are the talking point of choice.

"The ruling puts health coverage at risk for tens of millions of Americans, including those with chronic and pre-existing conditions, while also making it more hard for hospitals and health systems to provide access to high quality care", said Rick Pollack, president and CEO of the AHA.

Although the effective elimination of the individual mandate penalty starts January 1-before the filing deadline-HHS and the White House say the law will remain in place since O'Connor did not grant an injunction. The court's decision is likely to further heighten the focus and level of congressional action, especially among Democrats, although many Republicans also worry about both the practical and political consequences. What's more, Republican efforts to repeal the ACA failed in the same Congress.

"If this very bad ruling is upheld in the higher courts, it will be a disaster for tens of millions of American families, especially for people with pre-existing conditions", Schumer said in a statement.

If the U.S. Court of Appeals for the 5th Circuit reverses O'Connor, chances that the Supreme Court would hear the case are slim, according to The Associated Press.

White House spokeswoman Sarah Sanders said in a statement the law would remain in place pending its expected appeal to the Supreme Court.

On Friday, O'Connor ruled that after Trump signed a $1.5 trillion tax bill passed by Congress a year ago that eliminated the penalties, the individual mandate could no longer be considered constitutional. As lieutenant governor, he first joined an anti-ACA lawsuit in 2011-a year after President Obama signed it into law-which Mississippi State Sen.

"We'll admit to a certain satisfaction in seeing the Chief Justice hoist on his own logic", the Journal editorial said. "This ruling must be overturned".

For their part, in the wake of the December 14 ruling, the Trump administration and congressional Republicans have promoted the illusion that they will seek to defend protections for those with preexisting conditions.

"That is a ridiculous ruling and you don't have to rely on a doctor like me", Dr. Emanuel said. "In any case, the Supreme Court's "severability" doctrine calls for restraint in declaring an entire law illegal merely because one part of it is".
