McConnell: If Democrats investigate Trump, it could help him win re-election

Brett Kavanaugh is the first member of the Supreme Court to hire an all-female class of law clerks

CNN anchor Jim Sciutto implied as much last week when dismissed the personal attacks against Kavanaugh as nothing more than "politics". As a textualist, Kavanaugh cares about the correct interpretation of the Constitution and he understands that government exists to protect individual liberties.

In a letter Wednesday to the U.S. Court of Appeals for the 10th Circuit, Roberts said he selected the court in Colorado to "accept the transfer and to exercise the powers of a judicial council with respect to the identified complaints and any pending or new complaints relating to the same subject matter".

If the high court had agreed to hear the case, Kavanaugh would not have participated.

The Trump administration had urged the high court not to take the case because the EPA now is reconsidering the regulation and agrees with Kavanaugh's interpretation of the law.

Merrick Garland, the chief judge of the D.C. Circuit, typically deals with ethics complaints, but he apparently stepped aside from complaints against Kavanaugh. Only Samuel Alito and Stephen Breyer participated in White House events after they had been sworn in and begun work as justices, according to the court's records on the current crop of justices. Public servants, such as the justices, rely upon the trust of the people, and Kavanaugh being an accused perpetrator of sexual assault breaks that trust. The big question, they agree, is whether conservative enthusiasm will last until November 6 or fade away, victim to the historic pattern of midterm congressional losses by the party holding the White House and the ever-changing parade of distracting controversies prevalent under Trump.

Moreover, Kavanaugh is an advocate for social change. By Senate GOP rules, he can hold the position for six years.

Progressives are furious that Democrats keep allowing Trump to reshape the courts for generations without putting up a fight, especially after a bitter and bruising fight over Brett Kavanaugh's nomination to the Supreme Court.

"You will go down in history as the most naive person ever to be in Congress you (expletive), (expletive), feckless, naive woman!" one called yelled.

Speaking at a police convention in Orlando later, the president said the allegations against the justice were "brought about by people that are evil".

My second issue was the way Kavanaugh handled the affair. He demonstrated that strength does not mean meekness.

Murkowski's explanation for her vote was moderate but totally understandable: "He's not the right man for the court at this time".

At one point, Kavanaugh could be seen having a lighthearted exchange with liberal Justice Elena Kagan, seated next to him.

The justices privately made the decision to reject the appeals by an environmental group and companies that supported the regulation before Kavanaugh's confirmation, and announced the action on Tuesday.
