S. Africa's top court legalises personal, private cannabis use

Constitutional Court in Johannesburg has ruled that the personal use of marijuana is not a criminal offence. South Africans are allowed to smoke and grow dagga at home

Deputy Chief Justice Raymond Zondo has upheld earlier high court judgment.

The ruling further declared that the current act which regulates the use of dagga was unconstitutional and instructed Parliament to make the necessary amendments to the act within 24 months of the date of the court's ruling.

South Africa joins Zimbabwe which in April became the second country in Africa, after Lesotho, to legalise the use of marijuana for medical use.

A court in the Western Cape region ruled in March that a ban on cannabis use by adults at home was unconstitutional, effectively decriminalising it in the province that includes Cape Town.

And while thousands of naturalists, herbalists, homoeopathy advocates and dagga smokers all over South Africa celebrate the landmark ruling, questions surrounding the practical implications of the judgement have begun to surface.

SA's Constitutional Court has now handed down its own decision, which should be the final say in the matter: Forget 4/20, it looks like 9/18 will be a more significant number for South African smokers now.

The news comes following claims that Coca-Cola is in "serious talks" with a cannabis production company to make a cannabis-infused drink.
