Back in October, Johnny Bobbitt Jr. received viral attention after he selflessly gave away his last $20 to fill up a woman's tank of gas after she became stranded on the I-95.

Bobbitt, a former Marine and first responder, spent his last $20 to help McClure buy gas after her auto broke down on the I-95 exit ramp near Philadelphia.

When he bought her the petrol, she didn't have money to repay him at the time, but sought him out days later to give him the money, and visited him a few more times to bring food and water.

McClure and D'Amico set up a GoFundMe page to collect funds to help Bobbitt get a leg-up in life. The couple raised more than $A540,000 for Bobbitt but must now turn over what's left of the cash. Updates posted to the GoFundMe page and Instagram show the couple with Bobbitt in New York City four months ago, as well as Bobbitt sharing his journey to sobriety.

Homeless veteran Johnny Bobbitt has filed a lawsuit against the New Jersey couple who raised money for him on GoFundMe. The news agency reported that the judge also instructed them to provide an accounting of how the money has been spent.

The pair denied Bobbitt's allegations, claiming the money already given to him was spent on drugs, overdue legal bills and dispersed to his family members.

D'Amico told Kelly they would allow a forensic accounting of the remaining funds, which they believe may be as little as $150,000 after Bobbitt spent money on family, a trailer, truck and drugs.

In an interview with ABC affiliate WPVI in Philadelphia, Bobbitt said the couple used the money on trips, gambling and shopping sprees.

The twosome appeared on the Megyn Kelly Today show, where D'Amico claimed Bobbitt squandered $25,000 within 13 days.

Their lawyer argued in court that Mr Bobbitt had received more than $200,000 from the fund.

Lawyers for Mr Bobbitt, 35, allege in the lawsuit that the couple used it to "fund a lifestyle that they could not otherwise afford".

'He's really left us with no choice but to go forward, ' said Mr Fallon, one of two pro bono lawyers from Cozen O'Connor in Philadelphia whom Bobbitt retained last week.

"The idea my clients are the bad guys.is completely not true", Ernest E. Badway said, according to the Philadelphia Inquirer.

D'Amico said in the TV interview: "I wanted to make sure that at the end of the day when he was ready, that there was something left for him".

But Bobbitt said he saw troubling signs for the money that thousands had donated to him. "And if the monies aren't in the bank, they can pull their money out of their pillowcases and have them delivered to you, to be handed over and placed in a trust account", Dow responded. "We're happy to help Johnny and help see that the generous donations of 14,000 people are honored".

The money that came to Bobbitt couldn't stop his addiction.
