California will become the first state to eliminate bail for suspects awaiting trial and replace it with a still murky risk-assessment system under a bill signed Tuesday by Gov.
Smittcamp agreed the cash bail model is outdated but said it's going to take time and resources to put a new system in place.
"Today, California reforms its bail system so that rich and poor alike are treated fairly", Brown said in a statement.
The Governor has waited almost four decades to revamp the state's cash bail system.

According to the bill, most suspects accused of nonviolent felonies will be released within 12 hours of booking, while those charged with serious, violent felonies will stay in jail before trial. However, in other instances, defendants will be scored on how likely they are to show up for their court date, the seriousness of their crime, and the likelihood of recidivism. Instead of setting money bail amounts, the legislation allows for non-monetary release conditions for eligible defendants, such as Global Positioning System monitoring or home detention with electronic monitoring.
The goal of the legislation is to eliminate human bias in court proceedings, but critics argue the new system that will be created by the courts runs the risk of perpetuating discrimination.
The new law gives judges wide latitude to decide what to do with other suspects based on their likelihood of returning to court and the danger they pose to the public. Atkins said lawmakers would resume work on the effort next year. Ultimately, as it is written, he told the Sacramento Bee, the law discriminates against the poor.
"California continues to set the standard for leadership on policies to prevent climate change from further eroding the safety and health of our great state, and our great nation", she added.
