Gov. Brown Signs Bail Reform Bill

California will become the first state to eliminate bail for suspects awaiting trial and replace it with a still murky risk-assessment system under a bill signed Tuesday by Gov.

The Governor has waited almost four decades to revamp the state's cash bail system.

Cash bonds, widely used in the USA, often mean that poorer defendants remain jailed pending trials, while more financially well-off suspects can afford to pay the bonds and are freed.

With some exceptions to be determined locally and sometimes even case by case, "low risk" individuals will be released, "medium risk" individuals could be released depending on the decision of the local assessment agency and "high risk" individuals will remain in custody as determined by a judge.

According to the bill, most suspects accused of nonviolent felonies will be released within 12 hours of booking, while those charged with serious, violent felonies will stay in jail before trial. Instead of setting money bail amounts, the legislation allows for non-monetary release conditions for eligible defendants, such as Global Positioning System monitoring or home detention with electronic monitoring.

The goal of the legislation is to eliminate human bias in court proceedings, but critics argue the new system that will be created by the courts runs the risk of perpetuating discrimination.

The new law gives judges wide latitude to decide what to do with other suspects based on their likelihood of returning to court and the danger they pose to the public. Atkins said lawmakers would resume work on the effort next year. Ultimately, as it is written, he told the Sacramento Bee, the law discriminates against the poor.

"California continues to set the standard for leadership on policies to prevent climate change from further eroding the safety and health of our great state, and our great nation", she added.

He contended the law is bad for the people of California.
