December 16 Gang Rape Convicts To Hang, SC Rejects Review Plea

India's Supreme Court upholds death sentence in Delhi rape case

The apex court, which dismissed the review pleas filed by three of the four death row convicts of the sensational December 16, 2012 Nirbhaya gangrape and murder case, said the courts can not be held for committing any illegality in awarding capital punishment in "appropriate cases" till death penalty remains in the penal code.

On Monday, the court rejected the review petition of three of the six assailants - Mukesh Singh, Pawan Gupta and Vinay Sharma, all in their 20s - who had asked the court to consider commuting their death sentence to life imprisonment. She succumbed to the injuries at Mount Elizabeth Hospital in Singapore on December 29, 2012.The fourth death row convict in the case, Akshay Kumar Singh (31), did not file a review petition against the Supreme Court's May 5, 2017 verdict.

The court said the death-row convicts had failed to point out any "error" in the earlier judgment.

India's Supreme Court has upheld the death sentence in the 2012 New Delhi bus gang-rape case, a crime that sparked widespread protests leading to stronger anti-rape laws.

Five men and a juvenile had lured the 23-year-old trainee physiotherapist and her male friend on to a bus in New Delhi on December 16, 2012, before repeatedly raping the woman and beating both with a metal bar and dumping them on a road. After nearly two weeks, the victim succumbed to her injuries in a Singapore hospital where she was flown in a last ditch bid to save her life.

They can file one last petition with the Supreme Court, and if it's again rejected, they can seek presidential mercy, said A.P. Singh, the defence attorney. "They'll definitely be hanged very soon for the barbarism they committed", Asha Devi said.

"Even the Justice Verma Committee, whose recommendations were relied upon to reform the laws on sexual assault and rape, had opposed imposing the death penalty in cases of rape", Asmita Basu, Amnesty International India's Programmes director, was quoted by Business Standard as saying. On July 9, 2018 SC will decide the fate of the four accused of death sentence in the Nirbhaya gang-rape case.

She said the DCW would issue a notice to the Delhi Police and the Tihar Jail authorities, asking them to expedite the execution of the convicted rapists.
