Reuben Foster pleads not guilty to 3 felony charges in California

San Francisco 49ers linebacker Reuben Foster appeared before a judge at a plea hearing and entered a response of not guilty on all counts at the Hall of Justice in San Jose, Calif., on Tuesday.

Prosecutor Jim Dermertzis has said the district attorney's office will continue to prosecute the case against Foster even if Ennis does not cooperate with the investigation.

Ennis has said through her attorney that she initially lied about Foster hitting her on the morning of February 11 and that the injuries documented by police, including a ruptured eardrum and swollen lip, were suffered in a previous fight with a woman.

But Ennis also reportedly told police that Foster hit her "hard, but not that hard", and described the pain as being an 8 on a scale of 1 to 10.

After recanting her domestic violence accusation, Ennis said her injuries were suffered during a fight with another woman and not at the hands of Foster.

The 24-year-old Foster was charged with domestic violence with an allegation that he inflicted great bodily harm; forcefully attempting to prevent a victim from reporting a crime; and possession of an assault weapon. She also complained of ringing and poor hearing in her left ear, which subsequently was diagnosed as a ruptured ear drum.

The Santa Clara County District Attorney's office filed charges against Foster, 24, on April 12 stemming from a February 11 incident.

"The big question moving forward at the preliminary hearing: Will the accuser come to court and testify under oath to what she said through her attorney publicly?" said Clark, who is now a defense attorney and legal analyst.

Last month, Ennis recanted her initial domestic violence allegations through her attorney, Stephanie Rickard.

Tuesday's hearing was delayed more than one week by the Santa Clara County District Attorney, who requested more time to review purported video evidence involving the alleged victim. Ennis then went to a nearby intersection and flagged down a driver to call 911.

According to NBC Sports Bay Area's Matt Maiocco, Foster's attorney, Josh Bentley, informed the court Tuesday of Foster's plea. A friend of Foster's was staying at the house, though he says he was in his room at the time of the incident and didn't witness any argument or altercation.

The ex-girlfriend of Reuben Foster initially told responding police that the San Francisco 49ers linebacker had physically thrown her out of his residence and struck her several times. Both general manager John Lynch and coach Kyle Shanahan have said that if Foster is guilty of domestic violence he will be dismissed from the team. That's the standard we want on our team.
