Student alleging assault sues Michigan St.

The players are unnamed in the lawsuit. The lawsuit was filed on Monday afternoon in the U.S. District Court for the Western District of MI. University officials could not immediately be reached for comment by The Washington Post.

Michigan State is now the subject of multiple investigations into its handling of sexual abuse claims against Larry Nassar, a former doctor at the university and for USA Gymnastics. Adreian Payne and Keith Appling, members of that 2015 team, were among the names that surfaced in the ESPN report.

She also did not seek assistance from the school's Sexual Assault Program until 10 months later.

In the wake of widespread scandal, university president Lou Anna Simon and athletic director Mark Hollis have since resigned from their positions.

Michigan State University students are speaking out on a lawsuit filed by one of their own.

In it, three men's basketball players are accused of raping a female student in 2015. Earlier in the week, the team had been eliminated from the NCAA Final Four in a contest against Duke.

The suit alleges JD1 bought her a drink, introduced her to other MSU basketball players at the bar and that she was ultimately invited to a party. Because of her interest in sports journalism, she accepted.

"When plaintiff disclosed to the counselor that the three attackers were notable MSU athletes on the basketball team, the counselor suddenly announced to the plaintiff that she needed another person in the room with her and the plaintiff". She then accepted a ride to the party from two players - the party was at one of their off-campus apartments - and there was no party and her roommate was not there.

She accepted a auto ride to the party from John Doe 1 and 2 which was at an off-campus apartment. "At no point did she consent to the sexual activity". When she arrived, she realized there was no party and her roommate was not there. "There was no party" the lawsuit stated, "as few people were present".

Once they got to the apartment, the woman "was feeling discombobulated". She began to wonder if she might have been drugged.

The suit states that when on April 11, 2015, the then 18-year-old freshman female was at Harper's Bar near campus with her roommate. The room then went dark and she was allegedly thrown face down on the bed and held in place, unable to move. She was "was crying, she could not move, nor could she speak". There, she says was eventually held down and raped by all three players in a bedroom. "She tried to send a phone text, but she could not control her thumbs to formulate a text", the lawsuit said.

From the Detroit Free Press report on this story, according to MSU's policy on relationship violence and sexual misconduct, counselors generally are not permitted to report allegations of rape or relationship violence to the Title IX office or police.

The woman maintains she didn't remember anything until waking up on a couch the next morning.

"Plaintiff was so discouraged by the representations made by the MSUCC Counseling staff she became frightened to the point that she decided she could not report the rape (s) to law enforcement", the complaint states. Speaking with ESPN on condition that she not be identified, she said she anxious they would be charged with underage drinking, and counseling staff did nothing to ease those concerns.

In October 2015, the alleged victim was admitted to the Sparrow Hospital outpatient psychiatric day-program for intensive psychiatric treatment after becoming traumatized, depressed and withdrawn. She withdrew from classes that semester and, according to the lawsuit, explained to university officials she had been raped and was suffering from the trauma. "If only you knew what it felt like'". As such, attorney Karen Truszkowski alleged in the suit, the school did not provide her client with equal protection under the law.

About a week later, after telling a friend about the experience, the student said she went to the Michigan State University Counseling Center.

"Discouraging female students from reporting sexual assaults committed by student athletes plausibly creates an environment where football and basketball players can sexually assault females without repercussion."
