Sessions May Fire McCabe Days Before He's Set to Retire

WASHINGTON ― Andrew McCabe, who took over as acting head of the FBI after President Donald Trump fired former Director James Comey past year, may soon be fired by the Trump administration just ahead of his formal retirement date on Sunday, putting his pension in peril after more than two decades at the bureau.

Fox News has learned that the FBI's Office of Professional Responsibility made the recommendation to terminate McCabe.

The person familiar with the matter said McCabe is suspected of having not been forthcoming with officials from the inspector general's office who were investigating the media leak - an allegation he denies. President Donald Trump has long made McCabe a particular target of his ire, and the recommendation to fire the former No. 2 Federal Bureau of Investigation official could give him new ammunition.

Mr McCabe announced that he was stepping aside in January and taking a leave of absence.

The inspector general, Michael Horowitz, announced previous year that he would investigate several contentious decisions made at the F.B.I. and Justice Department during the 2016 presidential campaign.

That leaves Attorney General Jeff Sessions in charge of determining whether to fire McCabe, who is set to retire with full benefits on Sunday.

McCabe was caught up in an internal review, including an examination of his 2016 decision to allow Federal Bureau of Investigation officials to talk with reporters about a probe into the Clinton Foundation. "That process includes recommendations from career employees and no termination decision is final until the conclusion of that process".

At the time of her campaign, McCabe had no oversight of any Clinton investigation and recused himself from investigations relating to Virginia politics.

The situation now seems fraught for all involved.

Firing McCabe could put Sessions in a better position with Trump, but the attorney general would have to act fast.

McCabe has been a particular target of Trump's tweet-rage over time, with Trump focused on the financial backing McCabe's wife received from Virginia Gov. Terry McAuliffe - a longtime ally of the Clintons - when she ran as a Democrat for state senate in Virginia. If the Justice Department does not move on the recommendation, conservatives might view officials there as unfairly protecting McCabe.
