Net neutrality: a primer

In a Tuesday news release, Miller said he is joining attorneys general in 21 states, and the District of Columbia, in a petition for review in the U.S. Court of Appeals for the D.C. Circuit against the commission and the federal government.

The expected wave of litigation against the Federal Communications Commission's repeal of net-neutrality rules has begun. This would be a disaster for NY consumers and businesses, and for everyone who cares about a free and open internet. As home to countless start-ups and technology giants alike, California knows this better than anywhere else.

First approved by the FCC in 2015, the net neutrality rules require internet service providers like Comcast and Verizon to treat all online content the same. The effort also has support from Maine Republican Susan Collins, leaving it one shy of the number needed to pass, but with plenty more than the 30-vote threshold needed to compel Senate action. After the repeal of Net Neutrality, internet service providers will have the ability to charge customers differently for various types of service (e.g., video vs. text) and to offer different speeds of service to individual customers or groups of customers. But the resolution would probably run into difficulties in the House, where Republicans have a much bigger majority.

Net neutrality proponents' rage towards the regulation's repeal has reached risky new heights; FCC chairman Ajit Pai his appearance at the Consumer Electronics Show (CES) in January reportedly due to death threats.

"The repeal of net neutrality would turn internet service providers into gatekeepers - allowing them to put profits over consumers while controlling what we see, what we do, and what we say online", New York Attorney General Eric Schneiderman said in a statement announcing the lawsuit.

A spokeswoman for the FCC declined to comment on the lawsuit. "There's overwhelming public support for preserving net neutrality, so it's no surprise that there's strong support in Congress as well".

They argued the tougher oversight led to reduced investment in broadband networks - a point net neutrality supporters dispute.
