The New York City Police Department said Friday that a 2010 rape accusation against Harvey Weinstein is "credible" and the Hollywood mogul would have faced immediate arrest if he were now in the state and the incident was more recent. The Manhattan District Attorney's office tells CBS News that they have assigned a senior sex crimes prosecutor to investigate this case.

The 33-year-old met the disgraced Oscar victor at a party in October, 2010, and the pair shared a ride home together, she told CBS News.

She says Weinstein insisted they have drinks, and they ended up inside her apartment. The disgraced movie producer, 65, showed up at her building after repeatedly calling her, according to the publication.

The actress' attorney provided material to New York District Attorney Maxine B. Rosenthal, who is considering filing charges against the movie mogul.
