Australian Govt loses majority after court ruling

Labor says it has legal advice that Barnaby Joyce's decisions could be challenged if he is found ineligible

Joyce's citizenship was thrown into doubt in August when it was revealed that he is a New Zealand citizen by reason of descent.

This is a stunning decision that cost the government its one-seat parliamentary majority and forced a by-election.

Tensions within the Coalition have flared since the High Court last week booted Mr Joyce and his Nationals' deputy Fiona Nash from parliament due to their dual citizenship.

The High Court decision, delivered on Friday afternoon, means Australia's coalition government no longer has a majority in the House of Representatives.

The deputy prime minister is the main casualty, after being found to have held dual citizenship when he ran for election.

Ian who was a former Acting Speaker of the House in the Western Australian Parliament is on the move back to New South Wales and was keen to put his hand up for this by-election.

Australia's constitution states that members of parliament can not be "a subject or a citizen or entitled to the rights or privileges of a subject or citizen of a foreign power".

The deputy of Joyce's National Party, Fiona Nash, alongside senators Larissa Waters, Scott Ludlam and Malcolm Roberts have also been disqualified.

All said they had not been aware of their dual citizenship when they ran for election.

"I respect the verdict of the court", Mr Joyce said immediately after the verdict. However, the court said the lawmakers' foreign family ties were knowable.

But the court found Mr. Joyce was a New Zealander by descent at the time of his nomination a year ago.

Another two politicians under scrutiny, senators Matt Canavan and Nick Xenophon, were ruled to have been validly elected.
