Kenyan court throws out president's win, calls for new vote

In an unprecedented move, Kenya's Supreme Court on Friday annulled the August 8 election results, citing irregularities, and ordered the holding of new polls within 60 days.

Kenya became the first country in Africa to nullify a presidential election after the country's Supreme Court on Friday nullified the August 8 presidential elections which declared the incumbent Uhuru Kenyatta victor.

According to the results announced by the electoral commission before they were nullified, Kenyatta had been declared the victor with 54 percent of the votes.

Opposition leader Raila Odinga had petitioned the court challenging Kenyatta's win, claiming manipulation.

"This indeed is a very historic day for people of Kenya and by extension for people of the continent of Africa", he said. "We have no faith in the electoral commission as now constituted".

Mr Kenyatta has said he will respect the ruling and called for calm amid fears of unrest.

The disputed 2007 election led to politically-motivated ethnic violence in which over 1,100 people were killed. Meanwhile, Odinga hailed the judgment as historic.

Friday's ruling is the first time a Kenyan court has nullified an election result. "Clear evidence shows that the commission was taken over by criminals ... they must face criminal prosecution", he said, naming particular officials.

Meanwhile the People's Development Party President, Abed Bwanika says Kenyatta's stand is a lesson to Africa's presidents. He also said the role of worldwide observers who came to Kenya for the vote must be examined because they put stability ahead of credibility and had "moved fast to sanitize fraud". Kenyans now hope the repeat election will help determine who the most preferred candidate is.

Last month's election - which included the presidential poll in addition to races at other levels of government - was one of the most expensive ever held in Africa.

"We have said that you can not force Kenyans to go to the polls that is being supervised by thieves, we will not accept".

According to Ruto, the court overturned the will of the the people of Kenya, insisting President Uhuru won the elections fairly. It said the election commission "committed illegalities and irregularities.in the transmission of results, substance of which will be given in the detailed judgement of the court" that will be published within 21 days.

Odinga called for the election commission to be disbanded.

Supporters of the decision could be heard in the streets when the Chief Justice, David Maraga, read out the Court's decision.
