The second lawsuit, filed in federal court in Maryland by the American Civil Liberties Union, on behalf of the ACLU of Maryland and five now serving transgender service members, argues that the ban denies transgender people equal protection under the law and discriminates based on both sex and transgender status.

The brief includes copies of the President's tweets on the issue, including one on July 26 where he wrote: "Our military must be focused on decisive and overwhelming victory and can not be burdened with the tremendous medical costs and disruption that transgender in the military would entail". The president's policy proposals have also hinted at fights over abortion and doctor-assisted suicide. Upon the announcement, the White House official who spoke to reporters declined to comment on whether or current troops could remain under the new policy.

One of the Seattle plaintiffs is 33-year-old Army Staff Sgt. Cathrine Schmid, who has served for more than 12 years and is stationed at Joint Base Lewis-McChord south of the city.

After a review process, the Department of Defense concluded in 2016 that there is no basis to ban transgender men and women from openly serving in the military and the ban would be lifted, the lawsuit says. New transgender recruits were due to be permitted to enlist on July 1, it said.

The lawsuit is at least the third filed against Trump's transgender military ban.

Each lawsuit challenges the president's assertions that transgender people are a burden on the military due to their medical costs and that their service hurts the military's "readiness", citing studies finding that the costs are "minimal" and that in the 18 countries that now allow transgender people to serve openly, "there has been no significant effect" on readiness or cohesion. Tammy Duckworth, D-Illinois, an Iraq War veteran and a recipient of the Purple Heart, criticizing Trump's planned policy in a statement. If a person is willing to serve our country in uniform and meets all the basic standards and requirements, it doesn't matter what that person's gender identity is - just like race, religion and sexual orientation doesn't matter.

The six service members suing the Trump administration have served more than 70 years combined in the navy, army, air force, national guard and marines corps.

Like numerous other plaintiffs, Stone disclosed his transgender status following the Obama administration's change in policy.

Trump's directives were anticipated August 23 in a Wall Street Journal report and were the subject of an August 24 Baptist Press report, in which Southern Baptists with military and Defense Department experience underscored the biblical concept of gender and urged prayer for leaders of the Armed Forces. "The [ban] singles out transgender service members for different treatment by denying them coverage for medically necessary care that is inherently related to their transgender status and gender nonconformity", the complaint said.
